Judicial Protection of Privacy in Serbia
Judicial Protection of Privacy in Serbia
During the first day of Privacy Week, Partners Serbia will present the analysis of courts and public prosecutor's offices’ work, as well as implementation of their competencies for criminal prosecution and sanctioning in cases of illegal processing of personal data. We will present the analysis on court practice in terms of Article 146 of the Criminal Code, the work of public prosecutor's offices on criminal charges of the Commissioner, and the practice of misdemeanor courts in cases initiated under the new Law on Personal Data Protection.
Privacy and Data Protection amid the Pandemic
The second day of Privacy Week is dedicated to the pandemic. SHARE Foundation will present the main problems in the implementation of personal data protection standards in relation to the health data of Serbian citizens, within the fight against the pandemic. The global public health crisis has put significant pressure on the right to personal data protection, given the technical possibilities of mass collection and processing of data, in circumstances where suppressing the pandemic is the public’s primary goal. For the first time since the adoption of the General Data Protection Regulation (GDPR), and Serbia’s respective Law on Personal Data Protection, more frequent implementation of the provisions of these regulations is required. During this panel, we will talk about the extent to which established standards are applicable under these circumstances. A special focus will be placed on data processing within the health system, on the conduct and obligations of the media, on data processing in work environments, and on other typical mass data processing during a pandemic.
Privacy and Data Protection Considerations amid the Reform of the System of Social Protection
The third panel, organized by A11 - Initiative for Economic and Social Rights, will cover the topic of the new Law on Social Cards, the adoption of which has been announced for 2021. Given that there will probably not be any new public debates on this law, we will try to answer some of the key questions, from the aspect of improving the social protection system and the treatment of personal data within such processes.
Privacy of Children as Victims of Trafficking and Exploitation and Privacy of Members of the Queer Community
We will close Privacy Week with a final two-part panel. Atina association will organize the first part of the panel dedicated to the negative consequences of violating the right to privacy by "data breach" from institutions to the media, the unprofessional and insensitive conduct of journalists, as well as the position of children who are victims of violence and exploitation and the possibility of their successful recovery.
During the second part of the panel, the association Da se zna! will present the Guide on Personal Data Protection of the Queer Community, and review examples of violations of regulations, both in the areas of personal data protection and anti-discrimination, to the detriment of members of the queer community. Association Da se zna! representatives will also discuss the discriminatory provisions of the Rulebook on conditions, criteria and manner of selection of testing and assessment of donors of reproductive cells and embryos of the Ministry of Health of the Republic of Serbia and their consequences for LGBT privacy.
We look forward to seeing you!
