Sharing intimate content without consent – a reflection of the policy of impunity in Serbia

The phenomenon of ‘revenge porn’ – sharing intimate content without consent – has exposed a deep crisis in the rule of law in Serbia. 

Instead of protecting the rights and dignity of victims, in recent years we have witnessed a continuation of the policy of impunity, abuse of intimate content and other personal data of citizens in the media for political disputes and profit generation, and a lack of political will to enforce and improve regulations and provide protection to citizens, primarily girls and women. This is not just a matter of privacy protection – it is a matter of security, human rights, and trust in institutions. 
The latest case of student Nikolina Sinđelić is the most extreme example, as the institutions not only remained silent on the violation of rights but were themselves a source of violence. 

At the beginning of the month, the Minister of Justice announced amendments and additions to the Criminal Code and the criminalization of "revenge porn." 

Partners Serbia has been part of initiatives by a group of civil society organizations advocating for the introduction of this criminal act into our legal system. In this regard, we welcome the announcement of the introduction of the new criminal act, but wonder why the competent authorities have not applied existing provisions that could have provided (at least partial) protection to victims. 

Partners Serbia therefore calls on the authorities to stop the policy of ignoring and protecting perpetrators and to urgently: 

  • Criminalize revenge porn, 
  • Sanction media that violate human dignity, 
  • Provide protection and support to victims.
