Statement on the Disclosure of a Student’s Identity by the Ministry of Internal Affairs
Partners Serbia strongly condemns the actions of the Ministry of Internal Affairs of the Republic of Serbia, which, by publicly disclosing the identity of a student of the Faculty of Agriculture, directly endangered her safety, dignity, and right to privacy.
This is not only a serious violation of the Law on Personal Data Protection but also grounds for criminal liability, as it constitutes unauthorized disclosure of personal data under Article 146 of the Criminal Code.
This is not only a serious violation of the Law on Personal Data Protection but also grounds for criminal liability, as it constitutes unauthorized disclosure of personal data under Article 146 of the Criminal Code.
An institution that is legally obligated to protect citizens and their rights—including the right to personal data protection—knowingly published personal information that had previously been withheld by the academic community and the public precisely for safety reasons. Such conduct is not only legally unacceptable but represents an institutional act of intimidation and a message that the system will not protect those who speak out about violence.
We call on the competent public prosecutor’s office to initiate criminal proceedings ex officio against the responsible officials within the Ministry of Internal Affairs. We demand the immediate withdrawal of the disputed statement, a public apology to the affected individual, and the adoption of all necessary measures to ensure protection and remedy the harm done. Partners Serbia has submitted an initiative to the Commissioner for Information of Public Importance and Personal Data Protection requesting urgent supervision of data processing in this case.
